User Agreement

Welcome to Imbatenga ("the Website"), an online platform for browsing and listing real estate properties in Zimbabwe. By accessing or using the Website, you agree to comply with and be bound by the terms and conditions of this User Agreement ("Agreement"). Please read this Agreement carefully before using the Website. If you do not agree with any part of this Agreement, you must refrain from using the Website.
1. DEFINITIONS
"User": Any person who accesses, views, or interacts with the Website, including but not limited to buyers, sellers, real estate agents, and property developers.
"Property Listings": Information about real estate properties, including residential, commercial, and land listings, that are submitted by users to be featured on the Website.
"Services": The services provided by the Website, including but not limited to real estate listing, property search, and any additional features available to users.
2. ACCEPTANCE OF TERMS
By accessing or using the Website, you agree to the terms outlined in this Agreement. If you are using the Website on behalf of a company or organisation, you represent and warrant that you have the authority to bind that company or organisation to these terms.
3. USE OF THE WEBSITE
You agree to use the Website only for lawful purposes and in accordance with the rules and guidelines set out in this Agreement. You may not:
Post or submit false, misleading, or fraudulent information in any property listing.
Use the Website for any unlawful activity, including but not limited to fraud, scams, or illegal transactions.
Engage in any activity that disrupts, interferes with, or damages the functionality of the Website.
Attempt to access unauthorised areas of the Website or modify its content without permission.
4. PROPERTY LISTINGS
Accuracy of Information: While Imbatenga makes reasonable efforts to ensure the accuracy of property listings, we do not guarantee the accuracy, completeness, or timeliness of the information provided. It is the responsibility of the property owner, agent, or developer to provide accurate and up-to-date information.
Listing Approval: All Property Listings submitted to the Website must be approved by Imbatenga before being published. We reserve the right to reject any listing for any reason.
Ownership and Legal Compliance: By submitting a Property Listing, you confirm that you have legal authority to list the property and that all necessary permissions, rights, and title to the property are in place. You also confirm that the property complies with all relevant local laws and regulations.
Disclaimer of Liability: Imbatenga is not responsible for any disputes arising from property ownership, misrepresentation, or legal issues related to the properties listed on the Website.
5. USER ACCOUNTS
Registration: To access certain features of the Website, users may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update this information as necessary.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and are liable for any activities that occur under your account. If you suspect any unauthorised access to your account, you must immediately notify Imbatenga.
Prohibited Activities: Users are prohibited from sharing their account information with others or using another user’s account.
6. PAYMENT AND FEES
Fees for Listing: Imbatenga may charge fees for certain services, including but not limited to listing properties, advertising, or promoting listings. The current fees will be displayed on the Website and are subject to change.
Payment Methods: Payments for listing services or any other fees must be made through the methods specified on the Website. Users may be required to pay through mobile money services (e.g., EcoCash), bank transfers, or other accepted payment methods.
Refunds: All payments are refundable, as required by applicable law or if Imbatenga determines, at its sole discretion, to issue a refund.
7. INTELLECTUAL PROPERTY RIGHTS
Ownership of Content: All content, including text, images, logos, and designs, available on the Website is owned by Imbatenga or its licensors. You may not copy, distribute, modify, or create derivative works from any content on the Website without prior written permission.
User-Generated Content: You retain ownership of the content you upload, such as property listings, but by submitting content to the Website, you grant Imbatenga a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content as part of the Website’s services.
8. PRIVACY POLICY
Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Website, you consent to the collection and use of your data as described in the Privacy Policy.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Imbatenga and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Website or your inability to use the Website. 10. TERMINATION OF ACCESS
We reserve the right to suspend or terminate your access to the Website at any time, without notice, for violation of this Agreement or any other conduct that we deem inappropriate or harmful to the Website or its users.
11. CHANGES TO THIS AGREEMENT
Imbatenga may modify, update, or revise this Agreement at any time. Any changes will be effective when posted on the Website, and your continued use of the Website after the posting of changes constitutes your acceptance of the updated Agreement.
12. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement will be governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising from or relating to this Agreement will be subject to the exclusive jurisdiction of the courts of Zimbabwe.
